SVPA case. In a prosecution under the Sexually Violent Predators Act (SVPA), the district attorney obtained an order requiring petitioner to undergo updated mental health evaluations, and granting the district attorney access to petitioner’s treatment records. The Court of Appeal reversed, and the Supreme Court granted review. After review was granted, the Legislature passed urgency legislation which amended key provisions of the SVPA, including authorization of updated interviews and evaluations as well as access to treatment records. The Supreme Court held that the new provisions applied to this case. It is evident from the language of the amendments and their legislative history that the Legislature intended to address the issues raised in this litigation.
