The Ninth Circuit, in a 2-1 opinion, found reversible Wheeler error in a Three Strikes case in which the state appellate court had affirmed. The federal court rejected the contention that the prosecutor’s peremptory challenges against two African-American women were exercised in a racially neutral way in this drug possession case.
