Name: Criminal Justice Legal Foundation v. Dept. of Corr. & Rehab.
Case #: C100274
Opinion Date: 20250728
Subsequent History: Review granted 10/22/25 (S292887)
Summary

Proposition 57 permits CDCR to award custody credits beyond those authorized by statute, but does not permit awarding credits to advance indeterminate sentence parole eligibility date in a manner conflicting with a statute.  Regulations conflicting with statutes are invalid. For example, CDCR regulations may not conflict with PC 190(e), which states that conduct credits may not decrease the minimum term for a PC 187 sentence.
