Name: Dustin v. Superior Court
Case #: F039023
Court: CA Court of Appeal
District 5 DCA
Opinion Date: 07/09/2002
Subsequent History: Rev. denied 9/25/02.
Summary

Penal Code section 190.9 requires that opening and closing statements to the grand jury in a death penalty case be transcribed by a court reporter. Thus, where the prosecutor ordered the court reporter to leave during those proceedings, it was error for the trial court to deny a motion to dismiss the indictment.
