Summary

Following a search of the minor’s room, the police found a rifle and three different types of ammunition. A petition was filed charging the minor with possession of an assault weapon, and three violations of Penal Code section 12101(b)(1) for possession of three different kinds of ammunition. The petition was sustained, and the minor appealed. The appellate court reversed the three violations of section 12101. Section 12101 proscribes possession of “live ammunition.” That term ordinarily includes the plural, and, as used in the statute, prohibits the possession of any quantity of ammunition. Therefore, the minor’s possession of three types of ammunition was a single offense.
