Summary

Darlice C. sought habeas relief in the form of an order to the juvenile court to vacate the order terminating her parental rights. She contended ineffective assistance of trial counsel in that counsel failed to advise the court of the existence and applicability of the “sibling exception” to adoptability. In this opinion, the appellate court issued an order to show cause. The appellate court found that the petition stated a prima facie case, and declined to follow In re Meranda P., concluding that Darlice was entitled to seek review. Because the termination order was on appeal and not yet final, habeas corpus review will not delay the finality of the order.
