Name: In re Ivan J.
Case #: B142656
Court: CA Court of Appeal
District 2 DCA
Division: 6
Opinion Date: 03/28/2001
Subsequent History: Rev. den. 6/27/01
Summary

There was sufficient evidence to support a finding that appellant had falsely identified himself to a peace officer under Penal Code section 148.9, subdivision (a), where the minor gave his correct name, but falsified his birthdate to avoid a citation for possession of tobacco. The language of section 148.9, subdivision (a) show that it did not intend to punish only those persons who give a false name, but those who make false representations concerning their identity. The legislative history of the statute further support this interpretation of the statute.
