The transfer of a juvenile dependency case from state court to tribal court deprives the California Court of jurisdiction and therefore precludes an appeal from the transfer order.
The minor appealed from an order of the juvenile court transferring the dependency proceeding to the Karuk Tribal Court. No party requested a stay of the transfer order prior to the transfer and acceptance by the tribal court of the case. The appellate court dismissed the appeal for lack of jurisdiction, holding that the California court lost all power to act in the matter, and that it could not provide effective relief to the minor because it had no power to order the tribal court to transfer the case to the state court.
