The trial court erred when it terminated mothers parental rights in a proceeding separate from the one in which fathers rights were terminated. California Rules of Court, rule 1463(a), requires that the termination of both parents rights occur in one hearing. The point of the rule is to insure that the child will be freed for adoption following termination. Although the trial court committed a procedural error, however, it was harmless. Fathers rights were also terminated five months later, and the child was freed for adoption. Therefore, the result would not have been different had the parents rights been terminated simultaneously.
