The court held that a Texas statute which prohibited two persons of the same sex from engaging in sodomy or oral copulation violated the due process. Prohibition of private sexual acts by adults infringed upon the liberty interest protected by guarantee of due process. The court expressly overruled Bowers v. Hardwick (1986) 478 U.S. 186.
