Summary

The Court of Appeal holds that requiring defendant to share a single Spanish-language interpreter with his two codefendants at their preliminary hearing denied defendant a substantial right. An error denies the defendant a substantial right when it reasonably might have affected the outcome. Failure to provide an individual interpreter precluded defendant’s ability to meaningfully participate in a criminal proceeding and limited his ability to challenge the evidence against him.
