The United States Sentencing Guidelines are not mandatory on sentencing courts and are not to be presumed reasonable. The Court granted the petition for certiorari and reversed the judgment of the Court of Appeals, finding that it was plain from the comments of the sentencing judge that he applied an impermissible presumption of reasonableness to the sentencing guidelines in this case.
