Summary

In a highly fact-specific case, the Court affirmed the granting of a habeas petition alleging Brady error in failing to disclose the prosecutor’s notes recording opinions of the doctor performing the autopsy. The notes contained information which could have been used either for impeachment of the doctor or to refute jurisdiction (because death occurred in another state). The Court concluded that it need not resolve the possible conflict over whether Brady material must be admissible evidence. Even though the notes may not have been independently admissible, they could have been used to impeach, which made them material under Brady.
