Summary

Defendant took full body photographs of young girls in their swimming suits at a water park. There was no evidence that the girls knew their photographs had been taken. The court held that the evidence was insufficient to support a holding order for violation of Penal Code section 647.6, subdivision (a), annoying or molesting a child under 18. Even if the statute did not require the girls to know their picture was taken, the taking of the photographs was not an act that was objectively and unhesistatingly irritating or disturbing.
