Name: People v. Anderson
Case #: H051905
Opinion Date: 20260313
Summary

The good faith exception to Fourth Amendment exclusionary rule applies to violations of the California Electronic Communications Privacy Act (PC 1546 et seq.). Defendants challenged the police search of decedent’s phone conducted with the consent of the decedent’s mother. Even assuming the mother was not the phone’s “authorized possessor” (PC 1546(b)), the officers’ objectively reasonable belief that she could consent meant that it was not necessary to suppress the phone’s contents.
