The crime of vandalism with less than $400 in damage is a public offense. It may be raised to a felony if committed for the benefit of a street gang charged under Penal Code section 186.22, subdivision (d). However, a street gang enhancement under Penal Code section 186.22, subdivision (b)(1) may not be applied to such misdemeanors.
