Name: People v. Arzate
Case #: B162971
Court: CA Court of Appeal
District 2 DCA
Division: 7
Opinion Date: 12/15/2003
Subsequent History: Rev. den. 3/17/04
Summary

The jury’s findings that appellant had personally used a firearm and inflicted great bodily injury were inconsistent with the verdict convicting appellant of concealing a firearm in a vehicle. Along with other charges, the appellant was convicted of carrying a concealed firearm and of inflicting great bodily injury and personally using a firearm in the commission of that offense. Holding that the crime of concealment would necessarily end with the firearm’s use and exposure, the court ordered that the two special findings be stricken.
