Summary

Penal Code section 803, subdivision (g) was amended in 1996 and 1997 to permit the refiling of certain charges of sexual molestation of minors, even if a previous accusation of the same crime had been dismissed as time barred. The separation of powers doctrine prevents the refiling of charges to cases which had already been dismissed, if the dismissal had become a final judgment, under the law of finality which then pertained, before the refiling provisions became effective.
