Name: People v. Castellanos
Case #: B159673
Court: CA Court of Appeal
District 2 DCA
Division: 5
Opinion Date: 07/31/2003

The evidence was sufficient to uphold appellant’s conviction for violation of Penal Code section 472 (forgery of a public seal with intent to defraud). Appellant possessed a forged resident alien card but argued there was insufficient evidence of intent to defraud because he had not presented it to obtain money or property of value. The court held there was sufficient evidence of intent to defraud since the card bore appellant’s photo, which would create a legal right of an employer to employ him, and because it was apparently used to obtain a social security card.
