Name: People v. Chaffer
Case #: C042341
Court: CA Court of Appeal
District 3 DCA
Opinion Date: 09/02/2003
Subsequent History: 11/25/03 Rev. denied
Summary

Appellant could properly be convicted of inflicting a corporal injury on a cohabitant (Pen. Code, sec. 273.5, subd.(a)) and have an enhancement imposed for infliction of great bodily injury under Penal Code section 12022.7. Infliction of great bodily injury is not an element of Penal Code section 273.5; that statute prohibits infliction of any injury, regardless of its seriousness. Penal Code section 654 does not prohibit the imposition of a great bodily injury enhancement (Pen. Code, sec. 12022.7), which is a specific statute that operates as an exception to the more general provisions of section 654.
