Name: People v. Cook
Case #: S042659
Opinion Date: 05/17/2007
Citation: 40 Cal.4th 1334
Summary

Once a scientific procedure is determined to be accepted in the scientific community, as set forth by the criteria established in People v. Kelly (1976) 17 Cal.3d 24, variations in technique or procedure used in the testing is an issue that goes to the weight of the evidence rather than its admissibility. Admission of results of electrophoretic testing of dried blood stains is proper in that it meets the Kelly criteria.
