Name: People v. Ellis
Case #: B331474
Division: 8
Opinion Date: 20250203
Summary

Kidnapping conviction (PC 207) not supported by substantial evidence.  Defendant forcibly moved victim 10 feet from the sidewalk to the middle of the street before he fled when bystanders intervened. Both locations were in “full public view,” defendant had no greater ability to commit additional crimes while in the street, and the absence of passing traffic meant the street presented no greater danger to the victim. Conviction reduced to the lesser-included false imprisonment by violence (PC 236/237).
