The joinder of a burglary count with a receiving and concealing stolen property count substantially prejudiced defendant and deprived him of a fair trial. The court’s conclusion was based upon the combination of the following factors: the non-cross-admissibility of the evidence on the two counts; the relative weakness of the evidence on the burglary count in relation to the receiving count; and the conjunction of prosecutorial and instructional errors.
