Name: People v. Hardy
Case #: B343746
Opinion Date: 20260422
Summary

The Court of Appeal holds that neither assault weapons (PC 30600) nor short-barreled shotguns/short-barreled rifles (PC 33215) constitute arms that are entitled to Second Amendment protection because appellant failed to show that either type of weapon is commonly used for lawful purposes. Further, neither large-capacity magazines (PC 32310) nor silencers (PC 33410) qualify as arms subject to Second Amendment protection. Additionally, requiring a licensed firearms dealer to complete a transaction (PC 27545) does not violate the Second Amendment.
