Summary

The Profiler Plus DNA test kit, used in this case to establish identity, does not embrace any new scientific technique requiring a first prong Kelly (People v. Kelly (1976) 17 Cal.3d 24) hearing, to show that it has gained general acceptance in the relevant scientific community. One accepted methodology of DNA testing is polymerase chain reaction (PCR) and the Short Tandem Repeat Test (STR) is a subtype of PCR testing. The Profiler Plus test uses the PCR and STR testing methods. It is simply more sophisticated because it examines a greater number of genetic markers.
