Name: People v. Isayev
Case #: C101402
Opinion Date: 20250829
Subsequent History: Review granted 11/12/25 (S292860)
Summary

The availability of a youth offender parole hearing under section 3051 renders a juvenile offender ineligible for recall and resentencing under PC 1170(d).  Parole eligibility under section 3051 may render a juvenile offender ineligible for relief because the offender is no longer serving LWOP or its functional equivalent. Because defendant is statutorily eligible for a youth offender parole hearing at the age of 42, his 50-years-to-life sentence is not the functional equivalent of an LWOP term.
