Name: People v. Konther
Case #: G063674
Division: 3
Opinion Date: 20260612
Summary

A defendant has no reasonable expectation of privacy in semen samples he leaves at scene while committing a crime. Defendant moved to suppress warrantless investigative genetic genealogy analysis performed on semen samples collected from two rape victims. The trial court correctly ruled defendant voluntarily abandoned the semen samples and therefore the genealogy analysis did not constitute a Fourth Amendment “search.”
