Name: People v. Mearns
Case #: B150613
Opinion Date: 04/05/2002
Court: CA Court of Appeal
District 2 DCA
Division: 5
Citation: 97 Cal.App.4th 493
Summary

A trial court did not abuse its discretion when it awarded restitution to a victim of a forcible rape for the costs of relocating to another residence after she was violently assaulted in her mobile home. The victim testified that she sold her mobile home to the first available buyer because she could no longer live in it due to bad memories of the rape, and that it cost an additional $13,000 over the sale price to purchase another mobile home in a gated community where she felt safer. The trial court reasonably concluded that the enormous emotional trauma resulting from the rape forced the victim to move, and that the economic loss resulted from appellant’s conduct.
