Summary

Sex offender registration for a defendant convicted of misdemeanor indecent exposure is not cruel and unusual punishment. The Court of Appeal found no compelling reason to distinguish In re Alva (2004) 33 Cal.4th 254, which held that a registration requirement for possession of child pornography did not invoke the Eighth Amendment because registration is not “punishment.” Thus the registration ordered in this case was constitutional.
