Summary

DNA evidence, consisting of the the perpetrator’s genetic profile, calculated from the Hispanic database was admitted without adequate foundation because there was insufficient evidence that the perpetrator is Hispanic. The only evidence suggesting the perpetrator is Hispanic is that defendant, who is half-Hispanic, was present in the vicinity of the victim near the time of the crime.
