On remand from the California Supreme Court, the Court of Appeal held harmless beyond a reasonable doubt the trial courts error in instructing the jury under CALJIC 3.30 that a defendant could be guilty of a violation of section 290 “even if unaware of his obligation to register.” The trial court had instructed the jury elsewhere that it had to find that the defendant knew of his obligation to register at his second address, and the evidence was sufficient to support the jurys finding that the failure to register was willful.
