Penal Code section 1166 provides that the defendant shall be committed to custody following a general or special verdict, unless the court, applying certain factors, allows the defendant to remain out of custody. However, the statute does not apply when guilt is determined by plea rather than trial, and thus defendant’s bail was properly forfeited when appellant failed to appear for sentencing.
