A petition charging that appellant wilfully and deliberately aided or encouraged a suicide in violation of Penal Code section 401 was wrongly sustained where the victim’s attempt to commit suicide failed despite appellant’s active encouragement and furnishing of the intended means. Appellant’s actions, helping the victim steal 100 Nytol pills and alcohol, helping her to take them and encouraging her to go through with it, did, however, amount to a culpable attempt to commit the offense.
