Defendant had no reasonable expectation of privacy in a hole in the ground (covered with a board) of the common yard of his four unit apartment house into which he had placed drugs. Police officers had watched him from a neighbor’s property (with the consent of the neighbor) go to the back yard several times and reach down to the ground near the fence and police had received complaints of drug activity at the complex.
