Name: Pollard v. Galza
Case #: 00-16210
Court: US Court of Appeals
District 9 Cir
Opinion Date: 05/14/2002
Subsequent History: Cert. den. 10/21/02
Summary

Although defendant’s statement to the police was taken in violation of Miranda v. Arizona (1966) 384 U.S. 436, it was nevertheless voluntary, and thus could be used to impeach him at trial. The defendant himself asked the officer “What happened?” which lead to a conversation about the crime. The court did not find it determinative that the officer knew his continued questioning violated Miranda.
