Three years have passed since Governor Newsom signed the California Racial Justice Act, and appellate practitioners continue to grapple with how to best leverage this groundbreaking law to benefit our clients. Join CAP-LA Staff Attorney Peter Westacott and FDAP Staff Attorneys Deborah Rodriguez and Lauren Dodge as we unpack the procedural and strategic considerations for raising RJA claims on appeal. This webinar will include an overview of how appellate courts have interpreted and applied the RJA to date, and how to prepare for the passage of AB 1118 this fall. The RJA on Appeal Part II: Implicit Bias and Language-Based Claims

Arizona State University Clinical Professor of Law Mary Bowman will be joining us to provide information on implicit bias, and to discuss the use of racially coded language and its impact in our system of justice. Following Professor Bowman’s presentation, SDAP Staff Attorney Anna L. Stuart will take us through some examples from case law and recent superior court litigation to suggest ways in which language-based claims might be raised on appeal under the RJA.
