After the Court of Appeal initially reversed the denial of appellant’s Penal Code section 1172.6 petition at the prima facie stage, the case was granted review and held behind People v. Patton (2025) 17 Ca1.5th 549. After Patton was decided, the California Supreme Court transferred the matter back to the Court of Appeal with directions to vacate its prior decision and reconsider the cause in light of Patton. On transfer, the Court of Appeal ordered the matter remanded for the trial court to address appellant’s petition under the guidance set forth in Patton, including by giving appellant an opportunity to plead any additional facts that he believes support his petition. (Patton, at pp. 569-570.)
