The Court of Appeal agreed with appellant that the true findings on his two prior strike convictions for active participation in a criminal street gang had to be vacated. Because the record of conviction did not establish that those prior convictions, entered before Assembly Bill 333’s amendments to Penal Code section 186.22, satisfy the current elements of the statute, the Court vacated the strike findings under People v. Fletcher (2025) 18 Cal.5th 576. The Court also vacated the sentence in its entirety, and remanded for a full resentencing.
