The Court of Appeal agreed with the parties that the trial court erred when it imposed a $300 parole revocation fine under Penal Code section 1202.45 after staying his determinate terms under section 654 and sentencing him to life without the possibility of parole. A parole revocation fine is not applicable when a sentence is stayed under section 654 or does not allow for the possibility of parole. The court modified the judgement to strike the fine.
