At resentencing in August 2021, the trial court struck appellant’s prior prison term enhancements under Senate Bill 136 and corrected the unauthorized portion of the sentence, which increased the aggregate sentence. Appellant appealed and argued he is entitled to resentencing under Senate Bill No. 567 (2021–2022 Reg. Sess.) (Senate Bill 567). The Court of Appeal agreed and remanded the case for resentencing under SB 567.
