Summary

The Court of Appeal held that the San Joaquin County Human Services Agency and the juvenile court failed to comply with the requirements of the Indian Child Welfare Act of 1978 (ICWA) (25 U.S.C. § 1901 et seq.). The court conditionally affirmed the orders subject to full compliance with the ICWA. The court further ordered that if the juvenile court determines on remand that the ICWA applies, it shall vacate its previous orders terminating parental rights and conduct further proceedings consistent with the ICWA, including a new section 366.26 hearing (25 U.S.C. § 1914; § 224, subd. (e).).
