The Court of Appeal agreed with appellants’ arguments that it must vacate the gang enhancement allegation findings under Penal Code section 186.22 because there was no evidence the predicate offenses for the gang enhancements met the heightened requirements of Assembly Bill No. 333. The court remanded the matter to give the People an opportunity to retry those allegations under the law as amended by Assembly Bill No. 333.
