Appointment of Counsel Forms and Instructions

The Third and Fifth District Courts of Appeal have different practices related to the application for appointment of counsel so you will need to know which court will have jurisdiction of the appeal in order to submit the correct forms.

 

The Third and Fifth District Courts of Appeal have different instructions and applications for appointment of counsel. While the Third District has the same application for appointment of counsel in all cases, the instructions for filling out the form differ depending on whether the appellant is a minor or an adult. The Fifth District has different instructions and applications for the appointment of counsel depending on the incarceration status of the appellant and whether the appellant is an adult, a minor, or a parent in a dependency appeal. Note: In both the Third and Fifth Districts, a minor in a dependency appeal is not required to submit an application for appointment of counsel.
