The training videos on Capcentral.org are in a password-protected area of the website. Central California Appellate Program (hereinafter “website administrator” or “CCAP”) reserves the right to terminate usage rights to anyone who loans their password to a third party, or in any other way misuses access to the training videos in the password-protected area of Capcentral.org. “Misuse” includes but is not limited to: displaying training presentations to a third party, whether or not for personal gain; copying, distributing, or downloading for distribution any portion of a presentation from the website to a third party; or any copyright violation.

By using the password-protected area of Capcentral.org and training videos, you signify your assent to these terms of use. If you do not agree to these terms of use, please do not use the password-protected area of Capcentral.org or view the training videos. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time. Please check these terms periodically for changes. Your continued use of the password-protected area of Capcentral.org and the training videos following the posting of changes to these terms constitutes an acknowledgment that you agree to abide by these terms and conditions and any amendments or changes to them that may occur from time to time.

Although this may appear to be a list of “don’ts,” you should also realize that there’s a much larger list of things you are free to “do” with respect to using the training videos. This freedom, however, carries with it some degree of responsibility—not a legal responsibility, but a professional responsibility—needed to keep this area of the website functioning within its purpose of facilitating user-friendly project training to enhance and develop the education, practice skills, and research/writing skills of appellate panel practitioners.

Who Are the Users of the Password-Protected Area of Capcentral.org?

The list of participants for the password-protected area of Capcentral.org is presently “closed,” meaning the users are only project attorneys and those attorneys designated by the California appellate indigent defense projects—CCAP, ADI, CAP-LA, FDAP, and SDAP (collectively referred to as the “CAP projects”), as a currently active Court-Appointed Counsel (CAC) panel member (hereinafter referred to as “statewide panel”). A user may belong to one or more CAP project panels to be on the statewide panel. The users list for the password-protected area of Capcentral.org will be periodically compared to a statewide panel list; non-statewide panel members may be removed from the users list by the website administrator with or without notice by termination of the user’s access to the password-protected area of Capcentral.org.
